3. Cookies and tracking technologies
We use cookies, pixels, tags, software development kits, and similar technologies. We group them into the following categories:
- Strictly necessary. Required for the Site to function, including security, load balancing, and remembering your cookie preferences. These cannot be switched off.
- Statistics / analytics. Help us understand how visitors use the Site so we can improve it.
- Marketing / advertising. Used to measure advertising performance and to show you relevant advertising on other platforms. These may involve sharing identifiers with advertising partners.

The specific technologies we use may include Google Analytics 4, Google Ads and Google Tag Manager, the Meta (Facebook) Pixel, the LinkedIn Insight Tag, Microsoft Advertising and Microsoft Clarity, and similar tools. A current, itemized list of the cookies actually in use on the Site, including their purpose and duration, is available in our cookie policy and cookie settings panel, which you can open at any time from the link in the Site footer.
Consent. Where required by law, non-essential cookies are set only after you give consent through our cookie banner. You may withdraw or change your consent at any time using the cookie settings link in the footer. Withdrawing consent does not affect the lawfulness of processing carried out before withdrawal.
Browser signals. We honor the Global Privacy Control (GPC) and similar universal opt-out mechanisms as a valid request to opt out of the sale or sharing of personal information where applicable law requires.
4. How we use information
We use personal information to:
- Respond to inquiries, provide quotes, and communicate with you
- Provide, maintain, and improve our services and the Site
- Process transactions, invoice, and collect payment
- Measure and improve the performance of our marketing, including advertising attribution
- Send service messages and, where permitted or with your consent, marketing communications you may unsubscribe from at any time
- Detect, investigate, and prevent fraud, abuse, and security incidents
- Comply with legal obligations and establish, exercise, or defend legal claims
4.1 Legal bases (EEA, UK, and Switzerland)
Where the GDPR or UK GDPR applies, we rely on the following legal bases:
- Consent — for non-essential cookies, marketing communications, and any optional processing. You may withdraw consent at any time.
- Performance of a contract — to deliver services you have engaged us for and to take steps at your request before entering a contract.
- Legitimate interests — to operate and secure the Site, understand aggregate usage, and pursue business development, where those interests are not overridden by your rights.
- Legal obligation — to meet tax, accounting, and other legal requirements.
5. How we share information
We disclose personal information to:
- Service providers and processors who perform work on our behalf, including website hosting, email delivery, analytics, advertising, customer relationship management, scheduling, file storage, accounting, and payment processing. They are permitted to use the information only to provide services to us.
- Advertising and analytics partners, where you have consented or where permitted by applicable law, for measurement and interest-based advertising.
- Professional advisors such as lawyers, accountants, and insurers.
- Legal and safety recipients, when we believe disclosure is reasonably necessary to comply with law or legal process, enforce our agreements, or protect the rights, property, or safety of any person.
- Business transfers, in connection with a merger, acquisition, financing, or sale of assets, subject to appropriate protections.
We do not disclose personal information to third parties for their own independent marketing purposes without your consent.
5.1 “Sale” and “sharing” under U.S. state law
We do not sell personal information in exchange for money. However, when advertising cookies and pixels are active, identifiers and browsing activity may be disclosed to advertising partners in a way that certain state privacy laws define as a “sale” or as “sharing” for cross-context behavioral advertising, and that may constitute “targeted advertising.”
You may opt out at any time by using the cookie settings link in the Site footer, by enabling Global Privacy Control in your browser, or by emailing us at hello@generativedigital.com. We do not knowingly sell or share the personal information of consumers under 16 years of age.
6. Client data and our role as a service provider
When we deliver services to a client, we may access personal information contained in that client’s systems, such as website analytics, search console data, advertising accounts, customer relationship records, and content management systems. For that information, the client is the controller or business and Generative Digital acts as a processor or service provider.
We process such information only on the client’s documented instructions, only for the purposes of delivering the engaged services, and we do not sell it or use it for our own independent purposes. Our handling of client data is governed by the applicable services agreement and any data processing addendum. Individuals whose data is held by one of our clients should direct privacy requests to that client.
7. Retention
We keep personal information only as long as necessary for the purposes described in this Policy, which generally means:
- Inquiry and contact records — up to 24 months after the last meaningful contact, unless you become a client.
- Client engagement and deliverable records — for the term of the engagement and up to 7 years afterward, to meet contractual, tax, and recordkeeping obligations.
- Billing and transaction records — as required by applicable tax and accounting law, typically 7 years.
- Analytics and advertising data — per the retention settings of the relevant platform, typically 2 to 26 months.
We may retain information longer where necessary to resolve disputes, enforce agreements, or comply with law. When information is no longer needed, we delete it or de-identify it.
8. Security and international transfers
We use commercially reasonable administrative, technical, and physical safeguards designed to protect personal information, including encryption in transit, access controls, and multi-factor authentication on business-critical accounts. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.
We are based in the United States and our service providers may process information in the United States and other countries. If you are located in the EEA, UK, or Switzerland, your information may be transferred to countries that do not provide the same level of data protection as your home country. Where required, we rely on appropriate safeguards such as the European Commission’s Standard Contractual Clauses.
9. Your privacy rights
